ICO Decision Notice — EIR: Planning Application Information (2022)

In a planning-application information dispute, the council initially said all relevant material was on the planning portal and no further information was held. During the ICO investigation it identified further recorded information and invoked EIR exceptions late. ICO found breaches of EIR regulations 5(2), 11(4), and 14(2).

The council failed to answer an EIR request about traffic management around the McDonald's development in Aberystwyth within the statutory timescale. ICO found a breach of regulation 5(2) EIR and ordered a substantive response.
